WAIVER, RELEASE, AND ASSUMPTION OF RISK AGREEMENT

Riff's Workshop Blacksmithing Instruction — 230 Stony Ford Road, Middletown, NY 10940.

1. Assumption of Risk. Blacksmithing is inherently dangerous and involves serious risks including extreme heat, open flames, forges, molten or hot metal; burns, cuts, eye injuries, crushing injuries and amputations; flying sparks, slag, scale and debris; hand and power tools, grinders, presses and anvils; loud noise, bright light, fumes, smoke, dust, grease and vibration; slips, trips, falls and impact injuries; risk of permanent injury or death. I voluntarily and knowingly assume all known and unknown risks.

2. Release of Liability. To the fullest extent permitted by New York law, I voluntarily release, waive, and discharge Riff's Workshop, including its owners, instructors, assistants, agents, contractors, and affiliates, from any and all claims, demands, or causes of action for personal injury, death, or property damage arising out of or related to my participation. This release applies to claims based on ordinary negligence but does not apply to gross negligence or willful misconduct.

3. Facility Disclaimer. Riff's Workshop operates within a facility that it does not own or control. I release Riff's Workshop from any claims arising from structural conditions, utilities, or property conditions outside the scope of the instructional activities.

4. Safety Compliance. I will follow all safety rules, instructions, and demonstrations. Failure to follow safety procedures or to use required protective equipment may result in immediate removal from the activity without refund.

5. Indemnification. I agree to indemnify and hold harmless Riff's Workshop and all released parties from any claims, damages, losses, costs, or legal expenses arising from my participation.

6. Medical Consent. I authorize Riff's Workshop to obtain emergency medical treatment on my behalf if deemed necessary and agree to be financially responsible for any medical care received.

7. Governing Law. Governed by the laws of the State of New York. Any legal action shall be brought exclusively in Orange County, New York.

8. Severability. If any provision is invalid or unenforceable, the remaining provisions shall continue in full force and effect.

9. Acknowledgment. I have carefully read and fully understand this Agreement. I understand that I am giving up substantial legal rights by agreeing to this waiver, and I am agreeing freely and voluntarily.
